Terms and Conditions
1. Development Service
a) If you purchase development hours please note that if the task is completed before the estimated no.of hrs then the extra hrs will be refunded back to your account.
b) The quoted no.of hrs for development service are always an approximation and there is an always a possibility that the final work could take up more hrs as compared to the initial estimation in such a case client shall pay for the extra hrs spent on the task to receive the final changes.
c) The client must pay upfront for the project. The developer will start the work once the payment is confirmed.
d) The developer will provide a 15 day warranty period at the end of project completion, in this period the client can report any “bugs in the functionality”. However, many factors can come into effect here, such as, conflict with another plugin, server configuration/deployment issue, etc. In such a case, the developer reserves the right to investigate the issue and determine whether it falls under warranty. Also, it’s very important to note that feature requests or additional requirements are not included in this warranty and it is only limited to the bugs and issues in the functionality that has been mentioned in the project scope document.
e) Developer follows all industry best practices and coding standards for WordPress. If any update in the future after the warranty period breaks any of the customized code, the developer can look into the issue and fix the problem But the client must pay for these additional hours invested on the task.
f) Please note that any requirements or functionalities outside of the “Project Scope Document” (agreed upon before starting the project) are not part of this quote and cannot be worked upon in the current scope of work. Any work outside of this scope will be estimated separately and only after approval and payment from the client developer can start working on it.
g) 2. The code produced by the developer will be under GNU Public License similar to to the WordPress licensing which enables the developer:
The right to reproduce the code.
The right to create “derivative works” based on the code.
The right to distribute copies of the code.
The right to “display” the code; for example, by posting to a group.
2. Plugin Licensing
Our website grants you a non-exclusive limited license to use the Plugin plugin and other products sold through our website (https://elearningevolve.com) by Elearning Evolve (the “products”) under these Terms & Conditions (the “license) issued by our company. All purchased licenses are valid one year unless explicitly stated otherwise. The plugin is licensed under the GNU general public license (http://www.gnu.org/licenses/gpl.html).
3. Automatic Upgrades
Automatic Upgrades are available to customers who have purchased a support license. All purchased licenses are valid one year unless explicitly stated otherwise. You may not share or resell access to your support license key.
After we have successfully processed your payment, you will receive an email with the download link and support license key. This may take up to 1 hour to arrive but usually happens within minutes of placing the order. If you do not receive an email after this period, please contact us. You will be provided a login and password which can be used to access your plugin downloads.
You may not claim intellectual or exclusive ownership rights to any of our products. All products are the property of Elearning Evolve They are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.
Elearning Evolve offers WordPress plugins “as is” and with no implied meaning that they will function exactly as you would like or will be compatible with all 3rd party components and plugins. We do not offer support via email or otherwise support WordPress or other WordPress plugins we have not developed.
Support is offered only for paid plugins via a valid software license key obtained after your transaction is verified. The software license gives you access to our premium support forums, documentation and priority support ticketing system.
Support for FREE plugins is only limited to critical bug fixes inside the plugin and we do not guarantee to provide individual/dedicated support for the FREE version of the plugin. We only offer support for bug fixes in the plugin (i.e not specific to your site but general issues for all plugin users) for all feature request the client must purchase development hours by contacting us here
License holders cannot distribute, freely giveaway, or resell their license key. The license key is only transferable by contacting us and requesting an official transfer of the license to a new owner. The license is intended to be used on the license holders web site(s). Client site usage is permitted in situations where the license holder maintains an ongoing relationship with the client as a consultant.
Providing Plugin as a service or providing Plugin as part of a web hosting solution does not constitute an ongoing client/consultant relationship under these terms.
Only the license holder is permitted to request support or access support resources.
License holders are not permitted to re-post support forum content or documentation on any external websites, social media outlets, etc. Posting screen captures of this content is also prohibited. Violation will be grounds for immediate termination of the support license and all access to support content and product updates will be discontinued.
7. Transactional Emails
Elearning Evolve may on occasion send you email notifications related to your plugin license or new plugins that are added on our website. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices and other transactional emails related to the purchase of your plugin.
8. Price Changes
Elearning Evolve reserves the right, at any time, to modify or discontinue, temporarily or permanently, a support license with or without notice. Prices of all products are subject to change. Notice of price changes will be made on the site.
Our plugin is guaranteed to function on a clean installation of WordPress. We do not guarantee it will function with all 3rd party plugins or with all web browsers. We are not responsible for any plugin compatibility conflicts that may occur. It is our policy to support our plugins as best we can and we will provide support for 3rd party plugin conflicts at our discretion or as time allows. We are not responsible for any data loss that may occur as a result of installing this plugin.
